I’VELO URBAN GENERAL TERMS AND CONDITIONS

We, Asociația Green Revolution, an association registered and operating in accordance with Romanian legislation, based in Avrig Street no. 21-31, bl. U2, sc. 1, 10th floor, apt. 43, district 2, Bucharest, registered in the Register of Associations and Foundations attached to the Bucharest district 2 Court of Law under no. 36 of March 25, 2009 (“AGR”) promote the use of ecological and economic means and solutions of transport, in particular the use of bicycle as an alternative means of transport, in our activity.

For this purpose, you (“the User”) can enjoy bike rental services for recreational purposes (“I’Velo Urban Services”) at the I’Velo Urban bike rental automated stations (“I’Velo Urban Services”), under the terms and conditions specified below (“the Terms” or “I’Velo Urban Terms”):

  1. APPLICABILITY
  • The I’Velo Urban terms apply in relation to your possibility to benefit from I’Velo Urban Services and subject to your acceptance, they will form the Agreement between you and AGR for this purpose (“I’Velo Urban Agreement”).
  • You can benefit from I’Velo Urban Services, on the basis of subscription, under the conditions described below.
  1. I’VELO URBAN USER ACCOUNT
  • To benefit from I’Velo Urban Services you need to be the owner of an I’Velo Urban User account.
  • The I’Velo Urban User Account can be created in one of the following ways:
    • by you, by registering on the website ivelo.ro by indicating an e-mail address or address of your Facebook account and associating a password.

You have the obligation to use correct, complete, and accurate identification data for your registration and to update this data by editing the I’Velo Urban User Account, whenever necessary.

The use of incorrect, incomplete, inaccurate or misleading identification data shall entail your liability for any direct or indirect damage that may be suffered in any way by AGR or any of its partners or collaborators. AGR reserves the right to verify the accuracy of your identification data or contact details, including by collecting additional personal data (including but not limited to, for the purpose of confirming your identity in order to issue the I’Velo Urban Card).

  • by AGR, if you go personally to one of the I’Velo Relax Centers in Herastrau Park (the Aviatorilor or Arcul de Triumf subway stations) or in Tineretului Park (Șincai Entrance) or I’Velo Urban Location from Ion Bogdan Street no. 21 (“I’Velo Centers”), with an original identity document within its term of validity.
  • Only persons aged at least 16 years can benefit from the I’Velo Urban Services. For this purpose, you must confirm that you are at least 16 years of age when you register your I’Velo Urban User Account in any of the ways indicated in (b) above.
  • When registering your I’Velo Urban User Account, you will be required to certify the acknowledgement and acceptance of the Terms by ticking the appropriate box in the I’Velo Urban User Account. Your acceptance will result in the conclusion of the I’Velo Urban Agreement.
  • Failure to meet any of the above conditions will prevent you from benefiting of the I’Velo Urban Services.
  1. THE STATUS OF I’VELO URBAN USER
  • After successfully creating an I’Velo Urban User Account, you will acquire the status of I’Velo Urban User.
  1. I’VELO URBAN CARD
  • After creating your I’Velo Urban User Account, you will receive an access card for I’Velo Urban services (“I’Velo Urban Card”).
  • The release of the I’Velo Urban Card is conditional upon:
  • Your personal presence at one of the I’Velo Centers, between their working hours, with an identity document within its term of validity. Their work program is available for consultation at https://www.ivelo.ro/urban.

This condition can be fulfilled by presenting one of the following documents, in original: identity card, passport.

If, for any reason, there is any suspicion about your identity, AGR can ask you to present an additional identity document, through the staff of the I’Velo center concerned.

  • payment of the I’Velo Urban Card value, in the amount of 7 lei. Payment can be made at one of the I’Velo Relax rentals centers in Bucharest, at the locations indicated at https://www.ivelo.ro/relax, as well as a the headquarters located in Ion Bogdan Street, no. 21, between 10:00 – 18:00, from Monday to Sunday.
  • In addition, if you qualify for one of the categories of Users eligible for I’Velo Urban subscription discounts, you have the obligation to present a document attesting to this quality, in order to be able to subsequently purchase subscriptions at reduced prices.
  • On release, I’Velo Urban Card will be activated by AGR staff.
  • I’Velo Urban Card is unique, personal and non-transferable to others. For the avoidance of doubt, I’Velo Urban Card may only be used by you in order to benefit from the I’Velo Urban Services, exclusively in your name.
  • After the release of your I’Velo Urban Card, you will be able to login online in the I’Velo Urban user account, after having created an account with your e-mail address / Facebook account address and a password and having attached your I’Velo Urban Card series and associated PIN code.
  • Entering the wrong PIN code three times during authentication will result in your I’Velo Urban card being blocked and, consequently, you will be prevented from benefiting from the I’Velo Urban Services, even if you have a valid subscription. To unlock, you can contact AGR by phone at the following number 021 327 57 78.
  1. I’VELO URBAN SUBSCRIPTIONS
  • I’Velo Urban Services are available to you if you have a valid subscription on the date of taking any bicycle from the I’Velo Urban Stations.
  • You can select the desired subscription in your I’Velo Urban user account, on the website ivelo.ro or through the application available at the I’Velo Urban Stations. You can opt for one of the following subscriptions:
    • Daily Subscription, valid for a period of 24 hours from the first take-over of a bicycle from any of the I’Velo Urban Stations based on it, in the amount of 10 lei – Duration of the cycling session 45 min – Break between sessions 15 min;
    • Monthly Subscription, valid for a period of 30 days, from the date selected by the User, in the amount of 35 lei – Duration of the cycling session 45 min – Break between sessions 15 min;
    • 3-Month Subscription, valid for a period of 90 days, from the date selected by the User, in the amount of 60 lei – Duration of the cycling session 45 min – Break between sessions 10 min;
    • 6-Month Subscription, valid for a period of 120 days, from the date selected by the User, in the amount of 80 lei – Duration of the cycling session 60 min – Break between sessions 10 min;
    • Annual Subscription, valid for a period of 365 days from the date selected by the User in the amount of 100 lei – Duration of the cycling session 60 min – Break between sessions 5 min.
  • You can benefit from “Young” subscriptions if you are aged between 16-25 years. “Young” subscriptions can be purchased from the IVelo cards distribution centers and IVelo mobile app.
    • “Young” Daily Subscription, valid for a period of 24 hours from the first take-over of a bicycle from any of the I’Velo Urban Stations based on it, in the amount of 7 lei – Duration of the cycling session 45 min – Break between sessions 15 min;
    • “Young” Monthly Subscription, valid for a period of 30 days, from the date selected by the User, in the amount of 25 lei – Duration of the cycling session 45 min – Break between sessions 15 min;
    • “Young” 3-Month Subscription, valid for a period of 90 days, from the date selected by the User, in the amount of 50 lei – Duration of the cycling session 45 min – Break between sessions 10 min;
    • “Young” 6-Month Subscription, valid for a period of 120 days, from the date selected by the User, in the amount of 65 lei – Duration of the cycling session 60 min – Break between sessions 10 min;
    • “Young” Annual Subscription, valid for a period of 365 days from the date selected by the User, in the amount of 75 lei – Duration of the cycling session 60 min – Break between sessions 5 min.
  • You cannot combine several types of active subscriptions, for the same period.
  • You cannot change the subscriptions purchased. Also, you cannot carry forward subscriptions which you have not used, regardless of the reason.
  1. ONE PASS
  • ONE PASS is a service accessible only through the I’Velo Mobile App, available free of charge on Android and iOS, where you can take advantage of one I’Velo Urban bicycle rental for 2 hours;
  • ONE PASS is activated when the bicycle is taken over from an I’Velo Urban station by scanning the QR code on the rake where an available bicycle is found;
  • If you find a failure or you want to replace the bicycle, you have 15 minutes to do so from its taking over. After the bicycle replacement, the rental period resets again to 2hs;
  • If the bicycle is returned 15 minutes after the taking over, ONE PASS will expire;
  • If you have exceeded the 2hs, additional costs (indicated under item 10 – “Obligation of Returning”) will come into effect.
  1. TAKING OVER BICYCLES FROM THE I’VELO URBAN STATIONS
  • To take a bicycle from one of I’Velo Urban Stations, it is necessary to perform the following steps:
    • to authenticate at the control panel from the I’Velo Urban Station concerned by scanning the I’Velo Urban Card at the contactless reader and entering the PIN code;
    • to select an available bike and take it from the bicycle rack after 10 seconds. If you exceed this time limit, the operation will be interrupted, so it will be necessary to resume the authentication step.
  • A bicycle can also be taken over using the I’Velo Mobile App, scanning the QR code on the rake where an available bicycle is found, or by manually entering the dock number and bicycle number.
  • It is your obligation to ensure that, at the time of taking a bicycle from any of the I’Velo Urban Stations, you have an appropriate physical and mental condition to ride the bicycle.

For the avoidance of doubt, the consumption of alcoholic drinks, drugs or any hallucinogenic substances shall be deemed incompatible with cycling.

The possibility to benefit from an I’Velo Urban Service may be refused by AGR if you show, at any time, improper or uncivilized behavior with manifestations of physical or verbal violence against other Users, AGR staff or any other person, in general, as well as in any other well-founded cases.

AGR reserves the right to verify, at any time, the fulfillment of the conditions so that you can enjoy the I’Velo Urban Service.

  • Based on a valid subscription, you can take a single bicycle from the available fleet at the I’Velo Urban Station. If there are no bicycles available at that I’Velo Urban Station, you can contact AGR by phone at 021 327 57 78 to find out what I’Velo Urban Stations have available bicycles.
  1. DURATION OF EACH I’VELO URBAN SERVICE
  • Any bicycle taken over will be at your disposal for the duration of the cycling session, according to the purchased service. At the expiry of this term, you have the obligation to return the bicycle to any I’Velo Urban Station.
  • You will be able to take over another bicycle after the expiration of the breaks between the sessions of your purchased service, which comes into effect after the return of the bicycle. The number of such takeovers is unlimited provided that you have a valid subscription.
  1. YOUR GENERAL OBLIGATIONS
  • You have the obligation to use any bicycle only for the purpose for which it was made available to you, namely for recreational activities. Also, you have the obligation to use the bicycle as a good owner, observing the usual rules of use and operating conditions.

For the avoidance of doubt, it is strictly forbidden to transport passengers or dangerous substances, to participate in races with any bicycle taken from the I’Velo Urban Stations or to sub-rent it.

  • You have the obligation to use the bicycle safely and to comply with all the rules in force which may be relevant, including the rules regarding traffic on public roads. In case of failure to comply with any obligation, you will be solely responsible.
  • The I’Velo Urban Service is provided by AGR exclusively for your personal use. The use of the bicycle by other persons, during the time interval it is made available to you under the I’Velo Urban Agreement, is forbidden, unless AGR has given its prior written consent for such use. In case you allow or tolerate in any way the use of the bicycle by any other person, in the absence of a prior written consent from AGR, you shall remain personally and solely responsible to AGR.
  • In addition, you have the obligation to comply with any and all instructions received from AGR representatives in connection with the use of the bicycle handed over.
  • You have the obligation to report any faults found in any bicycle taken by using the application installed at the I’Velo Urban Station or by phone call at 021 327 57 78. You have to follow exactly the instructions received when registering your request. AGR will respond to such requests within a reasonable period of time, which shall not exceed thirty (30) days from the date of the request.
  1. THE OBLIGATION OF RETURNING
  • At the expiry of the duration of the cycling session, you have the obligation to return the bicycle to any I’Velo Urban Station and in the same condition as the one it had when taking it over.
  • To return the bicycle, it is necessary to perform the following steps:
  • To identify a free post at that I’Velo Urban Station (available posts are signaled by green light);
  • to position and fix the bicycle in the free post chosen. After fixing, the bicycle will be automatically locked, and the return will be deemed to have been performed.
  • to authenticate at the control panel from the I’Velo Urban Station concerned by scanning the I’Velo Urban Card at the contactless reader and entering the PIN code;
  • In case of delayed return of the bicycle, you will have to bear additional costs as delay penalties, as follows:
    • for delays between 1 minute and 30 minutes, the additional cost will be 3 lei;
    • for delays between 31 minutes and 60 minutes, the additional cost will be 6 lei;
    • for delays between 61 minutes and 90 minutes, the additional cost will be 9 lei;
    • for delays between 91 minutes and 1395 minutes, the additional cost will be 25 lei;

These additional costs will be indicated when authenticating in the I’Velo Urban user account.

  • If the bicycle is not returned within 24 hours from renting, you will be liable for damages equivalent to its value, plus any additional costs incurred by AGR for its recovery. For the purpose of this provision, you agree that the value of the bicycle is equivalent to its purchase price. It will be considered that a bicycle is not returned if the delay in return is longer than 24 hours from taking it over.

We specifically draw your attention to the fact that failure to return the bicycle constitutes the offense of breach of trust provided for by Art. 238 of the Criminal Code, punishable by no less than 3 months and no more than 2 years of imprisonment or by a fine. Consequently, if the bicycle is not returned, AGR reserves the right to notify the criminal investigation authorities, so as to take the necessary measures.

  • If the delayed return or failure to return a bicycle is due to causes independent of your fault (e.g. lack of docking places at the I’Velo Urban Station, defective posts, etc.), you have the possibility to request AGR to send a team to take over the bike or to ask for an additional period in order to hand over the bike to another I’Velo Urban Station, by contacting AGR at the following number 021 327 57 78. In the absence of a request made in this way, you will bear the consequences arising from the delay in return or failure to return any bicycle.
  • If the bicycle presents any defects or damages at the time of return, you will be required to bear the cost of repairing or replacing the parts which would be necessary to bring the bicycle to its condition at the time it was handed over to you. For the avoidance of doubt, the costs of replacing the relevant parts are:
  • /Total damage /Broken frame /Theft: 1,100 lei – bicycle model 26″ (Geniesser 6.4)
  • /Flange (clamping system): 500 lei
  • /Front wheel: 175 lei
  • /Rear wheel: 306 lei
  • /Chain guard: 25 lei
  • /PVC fascia board for front/ rear wheel: 180 lei
  • /Inner tube: 10 lei · /Tire: 27 lei
  • / Geniesser 6.4 Fork (black): 110 lei
  • /Shimano Shifter 3v : 60 lei
  • /Brake lever: 10 lei
  • /Crank: 25 lei
  • /Saddle: 30 lei
  • /Pedals: 25 lei / set
  • /Handle bar: 30 lei
  • /Handle bar support: 90 lei
  • /Bell: 5 lei
  • /Rear light: 17 lei
  • /Dynamo lamp: 40 lei
  • / Saddle seat post 27.2mm : 45 lei
  • /Antitheft device: 35 lei
  1. ADDITIONAL OUTSTANDING COSTS
  • In the event of infringement of the obligation to return the bicycle in due time and in good condition, you will be liable to pay additional costs representing delay penalties or the cost of repairing or replacing parts or the equivalent value of the bicycle.
  • In the event of failure to comply with this obligation, you will not benefit from I’Velo Urban Services, and any subscription will be blocked until full payment of the outstanding costs.
  1. PAYMENTS
  • Payment of subscriptions, as well as of any additional costs relating to the I’Velo Urban Services can be made online by bank card or in the I’Velo mobile app, or cash at one of the I’Velo cards distribution centers.
  • Bank card details of the I’Velo Urban User will not be accessible to AGR and will not be stored by AGR. The entity authorized to provide card data storage services is Europayment Services SRL, a Romanian legal entity, based in Mizil Street, no. 2C, Bloc Socum, 1st floor, on the right, District 3, Bucharest, Romania, registered with the Trade Register under no. J40/9950/2006, tax identification code 18773866.
  • In some cases, to ensure security of payments, you will be required to authorize payment by re-entering your password for the I’Velo Urban User Account or by using the fingerprint for mobile terminals which have this facility.
  • After payment of costs is confirmed, you will be issued the proof of payment in your I’Velo Urban User Account.
  1. AGR RESPONSIBILITY
  • AGR shall make every effort to maintain and repair the fleet of bicycles made available under the I’Velo Urban Service. Any defects, malfunctions or damage noted when taking over the bicycle, must be immediately brought to the attention of AGR by returning the bicycle to the I’Velo Urban Station wherefrom it was taken within 5 minutes of taking it over. If the bicycle is not returned within the set period of time, it is assumed that it was handed over in normal running order, without any apparent defects or faults.
  • AGR shall not be responsible in any way for or in connection with the use of the bicycle by you in a manner that is contrary to your safety and that of others or that breaches any of the obligations incumbent upon you.
  • AGR shall not be responsible for any data, information or materials downloaded or uploaded by you in your I’Velo Urban User Account that may be destroyed, lost or deleted as a result of disabling your account.
  • AGR shall make its best endeavours in order to remedy any errors relating to the operation of the I’Velo Urban Stations and constant review of its functions and settings.
  • Access to the I’Velo Urban User Account through the website ivelo.ro may include access to, sending and downloading the content provided on third-party websites considered by AGR as being useful in connection with the I’Velo Urban Services and which are not under its control or guidance. In the event that such links or references are used, the general terms of use applicable to those web pages shall apply. For the avoidance of doubt, AGR does not guarantee in any way the accuracy or timeliness of the information presented on the web pages to which reference is made by the website www.ivelo.ro. Access to, sending or downloading content provided by other web pages cannot be interpreted as an approval from AGR of the contents of the web pages concerned or of the products or services supplied or promoted by them.
  1. TERMINATION OF I’VELO URBAN AGREEMENT
  • The I’Velo Urban Agreement shall cease on the date of losing the status of I’Velo Urban User. The status of I’Velo Urban User shall be lost through (i) deactivation by you of your I’Velo Urban User Account, provided you do not have outstanding payments related to the I’Velo Urban Services; (ii) automatic deletion of the I’Velo Urban User Account, if you have not used your account for more than 2 (two) years since your last login, and you do not have outstanding payments for I’Velo Urban Services.
  • The I’Velo Urban Agreement may be terminated by: (i) the written consent between AGR and you to terminate the Agreement; (ii) unilateral denunciation of the Agreement by either Party, subject to a 10-day notice; (iii) termination of the Agreement by either Party.
  • Termination of the I’Velo Urban Agreement shall be without prejudice to your outstanding obligations at the time of termination.
  1. APPLICABLE LAW
  • These I’Velo Urban Terms shall be governed by and interpreted in accordance with the Romanian law.
  1. MISCELLANEA
  • Nullity or unenforceability of any provision of these Terms will not affect the validity or enforceability of the remaining provisions that will remain enforceable and will continue to have effect. In the event of any such nullity or unenforceability, AGR will replace the null or unenforceable provision with another provision that comes as close as possible to the initial intention.
  • Failure or delay by AGR to enforce any provision of these Terms will not constitute a waiver of that provision or of its enforcement.
  • These Terms constitute the entire understanding and the entire agreement between us and you relating to the provision of I’Velo Urban Services to you and will replace any previous promises, agreements, declarations, assumptions or implications, whether made orally or in writing, between us and you with respect thereto.
  1. SUBSEQUENT AMENDMENTS AND REVIEWS
  • AGR can modify the Terms, in which case this version will be replaced by a new version. Such modifications will be brought to your attention and will constitute a modification of the Agreement, being conditional upon your acceptance.
  • No changes to the Terms shall be binding on you unless you were properly informed and you accepted them.
